What this is
XDRIP Academy at xdripacademy.com is run by XDRIP Digital Management. These terms cover reading the site, holding an account, sitting labs, submitting work for review, and holding a credential. Reading Orientation and Year One needs no account and creates no relationship beyond these terms. Creating an account accepts them.
The Academy is education. It is impersonal, regularly issued, bona fide instruction, not tailored to any person's situation. Nothing on it is investment, tax or legal advice, nothing takes your figures and returns a number for you to act on, and nothing is a recommendation to buy, sell, hold or size anything. The site's disclaimer and its privacy statement are part of these terms.
Who can enroll
Enrollment is open to adults, 18 and over, in the United States, Canada, the United Kingdom, the European Union and EEA, Switzerland and Australia. You confirm your age at signup and that confirmation is recorded. The list of jurisdictions is enforced from the country the platform attaches to your request, at signup and on every lab page, and grows only after a legal review of each addition.
One person, one account. You are responsible for what is done with your credentials, and you tell us if they are compromised.
Your money is never involved
The Academy never requests, receives, holds, routes or verifies learner funds. No assessed component requires a live position, and no assessment reads a wallet balance. Where a lesson describes live practice, it is optional enrichment, is not graded, and is not a condition of any credential. The Academy has no referral or affiliate relationship with any trading venue and pays and receives nothing for any decision you make with money.
The practice wallet in the sandbox holds test tokens on a test network with no value. Its private key lives in your browser and you can lose it. That is the point of it.
Labs, review and credentials
Labs are generated from a seed, so each sitting is a different paper and any sitting can be rebuilt. Some labs are marked by a person against a published rubric, within the turnaround printed on the submission page, and one pass in five is marked a second time by a different assessor. A second mark never changes the decision you were given.
A credential is an internal designation issued by the Academy. It records that a named practical was passed on a date, carries a validity period and a renewal term, and claims no government, professional-body or accredited standing. A credential you earn keeps its date and its record if its name ever changes. We can withdraw a credential for work found not to be yours, and we will tell you why.
Some components open only after you accept a statement: the acknowledgment of base rates before the Senior year, and the consents to the Gauntlet labs. Each is recorded with its version and exact text and can be withdrawn from your account page, which closes what it opened.
Acceptable use
Do not submit work that is not yours, share a paper's contents with another learner before they sit it, attack the site or its users, scrape accounts, or use the Academy's name or a credential to imply an endorsement the Academy did not give. Do not use the Gauntlet's materials, techniques or templates against anyone. Any of these ends the account.
What you may do with the material
You may read, print and keep every lesson, template and guide for your own learning. You may quote from them with attribution. You may not resell them, teach from them for a fee, or present them as your own. Work you submit for review stays yours; you give the Academy a license to store it, mark it, keep it as the record a credential rests on, and use it, anonymized, to calibrate rubrics and assessors.
No warranty, and what we are not liable for
The Academy is provided as it is, free of charge. We do not warrant that any lesson is complete, current or correct for your situation, that any lab will be available at any time, or that any credential will be recognized by anyone. Tax and reporting material describes one jurisdiction as of the date shown on it, and rules change.
To the extent the law where you live allows, XDRIP Digital Management is not liable for any loss of money, data or opportunity arising from your use of the site or from any decision you make after reading it, and its total liability to you for any claim is limited to the greater of one hundred United States dollars or the amount you paid for the service, which is nothing. This limitation does not apply to fraud, to death or personal injury caused by negligence, to any right you have under consumer protection law that cannot be limited, or to anything else the law does not allow us to limit.
Ending things
You can close your account at any time from the privacy page; the rows go with it, except the records a credential rests on if you hold one, which are kept for its validity period. We can close an account for a breach of these terms and will say why. Withdrawing a consent is not closing an account.
Governing law and disputes
These terms are governed by the law of the State of Colorado, without regard to its conflict-of-laws rules, and any dispute that cannot be settled by writing to us first sits in the courts of El Paso County, Colorado, sitting in Colorado Springs. If you live in a jurisdiction whose law gives you the right to bring a claim where you live, nothing here takes that away. Before any claim, write to us at the address on the privacy page and give us thirty days to answer.
Changes
These terms carry a version number. A change bumps the version and the date at the top of this page, and a change that reduces what you may do or increases what you accept is announced to account holders before it takes effect. Version 1.
